FACTS: Two 12 year old girls decide to poison their teacher w/ rat poison and then steal her car. One girl tells two other students before doing so. Tells X and shows her rat poison on the bus ride to school. X tells her teacher, who tells principal and they are able to stop the attack from occurring.
HOLDING/RULING/RULE: When an actor possesses materials to be used in the commission of a crime, at or near the scene of the crime, and where the possession of those materials can serve no lawful purpose of tha ctor under the circumstances, the “substantial step” towards commission is strongly corroborative tog the actor’s overall criminal purpose.
