Trial court gave judgment to D and court of appeals affirmed stating that Moore had probable cause to believe that P was a felon. Michigan Supreme Court overruled saying a statute clearly said what was right
Plain language provided authority for a person to arrest another if the other person has committed a felony. One cannot arrest another if they haven’t committed a felony even if there is probable cause.
