Balfour v. Barty-King
Blowtorches. In Balfour v. Barty-King
The Barty Kings hired a contractor to unfreeze frozen pipes in their attic. They used a blowtorch which set fire to some felt. Court held Barty Kings strictly liable for the damage under Rylands v. Fletcher:
Using a blowtorch to thaw a pipe is recognized as a method of thawing out a pipe in an appropriate place and appropriate circumstances, yet in other places it is not only not a recognized practice but also an extremely dangerous practice, and one which no prudent workman or contractor would have adopted.
